Cognitive IQ Pty Ltd (ABN 62 617 252 892), trading as Career Campus
This Refund Policy establishes the circumstances in which Career Campus may provide refunds, credits, transfers or other remedies. It is intended to provide clear expectations while preserving all rights available to students under Australian Consumer Law and other applicable legislation.
Career Campus does not rely on a blanket "no refunds under any circumstances" policy. A term attempting to remove mandatory Australian Consumer Law rights may be unenforceable — the ACCC expressly states that businesses cannot take away consumer guarantees through statements such as "no refunds".
Where a Student voluntarily cancels before the course commences, Career Campus may consider a refund based on the date of cancellation, whether course materials or services have already been supplied, administrative costs reasonably incurred, whether a third-party service has already been purchased, the specific enrolment agreement, and applicable law. Any cancellation fee must be reasonable and lawful and will not apply where prohibited by law.
Once training or other course services have commenced, the Student may not automatically be entitled to a refund merely because they decide not to continue. Career Campus may consider services and materials already supplied or provided, assessments already undertaken, third-party costs, and the remaining portion of the course. Any refund assessment will remain subject to mandatory consumer rights.
If Career Campus fails to provide the contracted service, or a service does not comply with an applicable consumer guarantee, the Student may have rights to a remedy — which may include correction, continuation of services, replacement service, partial refund, refund, cancellation, or compensation where legally applicable. Australian and NSW consumer guidance confirms that remedies may be available where services do not meet applicable consumer guarantees.
Where a service involves a major failure under applicable Australian Consumer Law provisions, the Student may have rights including cancellation and a refund for the unused portion of the service, or compensation for reduced value, as applicable.
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage.
If Career Campus cancels a course before commencement and cannot offer a reasonable alternative, Career Campus will provide an appropriate remedy, which may include a refund of amounts paid for services not supplied, subject to applicable law.
Where a course is postponed, Career Campus may offer transfer to the revised commencement date, transfer to another suitable intake, another reasonable alternative, or a refund where required by law or otherwise approved under this Policy.
Failure to attend classes or participate in online learning does not automatically create a right to a refund where Career Campus has continued to make the contracted services available. This does not affect statutory consumer rights where Career Campus has failed to provide the contracted service.
Career Campus may consider special circumstances on a case-by-case basis, including serious personal circumstances, bereavement, significant unforeseen events, serious disruption, or circumstances substantially preventing participation. Supporting evidence may reasonably be requested.
Where fees are paid by instalments, cancellation or withdrawal does not automatically cancel amounts already properly incurred or due under the enrolment agreement. However, Career Campus will not seek payment contrary to mandatory consumer rights.
Approved refunds will generally be returned using the original payment method where practicable. Career Campus may require reasonable verification before processing a refund.
Once a refund has been approved, Career Campus will aim to process the refund within 10 business days, subject to payment-provider processing times, bank processing, verification requirements, and circumstances outside Career Campus' reasonable control.
Refund requests should be submitted in writing and include the student's full name, enrolment details, course, payment details, date of enrolment, reason for request, and supporting documentation where relevant. Requests should be sent to careercampusau@gmail.com.
Career Campus will consider each request having regard to the enrolment agreement, services already supplied and remaining, circumstances of cancellation, representations made during enrolment, applicable consumer guarantees, applicable legislation, and fairness and reasonableness.
Nothing in this Refund Policy is intended to exclude, restrict or modify any right or remedy that cannot legally be excluded, restricted or modified.
If a student disagrees with a refund decision, they may request an internal review, and Career Campus will seek to resolve the matter fairly. NSW Government guidance confirms that students can raise education/training issues with their provider and, depending on the circumstances, may have access to external complaint pathways.
Career Campus may review this Refund Policy periodically to ensure that it remains appropriate and consistent with applicable legislation.
